The process of buying a villa in Phuket may seem complex and confusing, but it is actually very similar to purchasing real estate in other major international markets.

Step-by-Step Process of Buying a Villa in Phuket

  1. Choosing the Right Villa

    Determine your ideal villa configuration, including bedroom count, architectural design, plot size, location, and nearby infrastructure. Always verify construction quality by visiting a show villa or the physical site (for completed units).

    Off-Plan Growth: On average, villas in Phuket appreciate by 20–30% during construction, making pre-sales or early off-plan entry the most profitable option for capital growth and rental returns. If you are purchasing remotely, virtual tours, high-resolution videos, and live video walk-throughs can be provided.

    Market prices vary by location, land plot size, built area, and finish quality. Generally, villas fall into two main categories:

    • Beachfront or Sea-View Villas: Prices for high-quality projects by tier-one developers start from $2,800,000.
    • Mountain, Lake, or Garden-View Villas: Entry prices start from $490,000.
  2. Reservation Agreement

    Once you select a unit, a Reservation Agreement is executed. It specifies buyer and developer details, plot numbers, site master plans, price breakdown, payment schedule, and official bank details.

    Note: Legal documents for foreign transactions in Thailand are executed in bilingual format (Thai and English). Documents in other languages are not legally recognized.

    Requirements & Deposit: To secure the villa and remove it from the market, a deposit averaging 1–2% of the property value is paid alongside submitting a copy of your international passport, email, contact phone number, and physical mailing address. Payments can be made via cash, credit card, bank transfer, or cryptocurrency.

  3. Sales and Purchase Agreement (SPA)

    Typically within 30 days of signing the reservation agreement, the first major installment (averaging 28%) is paid, following which the formal Sales and Purchase Agreement (SPA) is signed. The SPA outlines all final terms, floor plans, customized design modifications, price structures, and installment timelines.

    For off-plan purchases, villa construction commences upon receipt of this payment and typically lasts 12 to 24 months.

    Completed Villa Considerations: If purchasing a resold or existing villa, request the primary Land Department SPA (with three red official seals), the Chanote (Title Deed), and the Blue Book (Tabien Baan / house registration book). It is strongly advised to retain legal counsel to perform full due diligence to verify encumbrances or mortgages.

  4. Property Registration and Transfer

    Upon villa completion and full payment receipt under the installment schedule, ownership rights are registered at the local Land Department.

    When a foreigner purchases a villa in Thailand, two separate contracts are always executed: one for the building structure and one for the land plot.

    • Structure: Usually registered in the buyer’s name as Freehold.
    • Land Plot: Registered under the buyer’s name as a long-term Leasehold (30×3 years) or as Freehold via a registered Thai Corporate Entity.

    Following registration, you receive the Chanote confirming legal title. Government transfer fees paid at registration include:

    • Leasehold Registration Fee: 1.1% of the total lease value.
    • Freehold Registration Fee: Up to 6.3% of the total assessed property value (often shared 50/50 between developer and buyer).
